Buildings

Please, find below the process to follow for modifications:

When the correct planning permission is obtained from the Townhall, the Community will consider granting permission to all owners to extend their property provided that it is in accordance with the aesthetics and standards of the community and that they provide the Committee/administration with a detailed description of the work that is planned by filling in the application form available in Spanish or English.

In case of selling the property now, the notary will request that you provide: a certified approval from the Administrator, and you must also pay the corresponding price to declare the new useful m2 after the extension/modification or Change of Use. And it will be essential that your modification be included in the Book of Acts of the Community. That is why each year the Community includes said modifications at the General Meeting so that all the owners can authorize and ratify them.

Some modifications affect the surrounding houses, so the permission of the neighbours is also needed. (Without the permission of 100% of those attending the Meeting, the modification will not be authorized - even though it is already built - so it will be illegal and must return to the original state) Some modifications, (private pools, solar panels, etc), must always be voted and approved at the meeting before the installation.

Application
In all cases of construction work - even if the following provisions are complied with – an application form must be filled out in good time and approved before starting work. Application forms should be sent to the administrators with a copy to the committee e-mail address. Application forms are available in Spanish or English.

Construction and building modifications, including installation of balustrades, "dividing walls" between gardens, awnings, painting of exterior walls and gates etc. shall be in accordance with the above and the following provisions, ratification of which are decided at the Annual General Meeting (AGM) every year – this takes place in September.

Start
Work may not be started before it is approved by the committee. The approval from the committee is only an approval according to the internal rules of Zeniamar 5 that have been met. Committee approval is not an endorsement of that building technology, construction, safety and regulatory compliance. It is the owner's responsibility to ensure that the work is approved by the municipality ( Town Hall), if needed.

Walls
  • "Dividing walls" (walls of separation between gardens) can be established as a wall alone, balustrades alone or as a combination of walls and balustrades.
  • The height including any balustrades, must be identified on your application – heights are subject to permitted allowances so no building works should take place until you have permission from the administrators as authorised by the committee.
  • Both affected homeowners must agree. Balustrades and fences can be put on top of a perimeter wall, but only if the balustrade/fence and any plastic behind is white.
  • The wall must be in the appearance, colour and finish similar to the existing walls.
  • Existing exterior walls must be retained in their original colour and finish.
  • New exterior walls must be the same colour and finish as the existing exterior walls.

Awnings
Awnings must be cream and / or yellow.

Gates
Gates must be retained in their original colour or painted white.

Sheds
Sheds for storage must be placed by the end wall of a block. They must be constructed in accordance with the houses aesthetics. That means they must be built in the same materials and have the same surface, colour and finish as the walls of the houses. The size must be max. 2.5 x 1.25 meters

Balconies and Terraces
Balconies and terraces can be enclosed with glass.
Any framework must be white and made of aluminium or PVC.
Glass must be normal glass, possibly tinted.
Balustrades on the balcony / terraces must not be removed.

Application forms are in the private area.
